In the case between the Hon. Attorney General (Complainant-Respondent) and several Accused-Appellants involved in a family dispute, the court addressed whether the conviction for murder under Section 296 of the Penal Code was sustainable in light of provocation and evidence of a sudden fight, or if culpable homicide not amounting to murder under Section 297 was more appropriate. It was held that the evidence supported a finding of provocation and a sudden fight, thereby altering the conviction from murder to culpable homicide not amounting to murder under Section 297, and adjusting the sentence accordingly. The principle reaffirmed is that where adequate provocation and absence of premeditation are established, a conviction under Section 297 is warranted rather than under Section 296. This
