J. B. Textiles Industries Ltd v. Minister of Finance and Planning – sllr 1981 volume 1 page 156
In the case between J. B. Textiles Industries Ltd. (and J. B. Fishing Industries Ltd.) and the Minister of Finance and Planning, the court addressed the validity of vesting orders (P2 and P7) made under the Business Undertakings (Acquisition) Act, No. 35 of 1971. It was determined that both orders were null and void, finding that mala fides and improper procedures vitiated the government’s actions. The principle reaffirmed is that statutory powers for acquisition must be exercised bona fide and in accordance with procedural safeguards. Reliance was placed on the Business Undertakings (Acquisition) Act, the Evidence Ordinance, and general principles of administrative law, highlighting that mala fides, coupled with disregard for statutory protections, will invalidate executive acts.
