In the case between Sri Lanka State Trading (Consolidated Exports) Corporation and Dharmadasa, the court addressed the issue of whether the notice of appeal was filed within the statutorily prescribed fourteen-day period in accordance with Section 754(4) of the Civil Procedure Code. It was held that the notice of appeal, having been filed on the nineteenth day after the judgment, was out of time as the last permissible day (after excluding the judgment day, the day of presentation, and intervening Sundays) was 16th June. The principle reaffirmed that computation of limitation periods must strictly adhere to the clear statutory language, with judicial interpretation applying only within those boundaries, and public holidays and Sundays alone are excludable unless otherwise specified by law.
