In the case between SmithKline Beecham Biologicals S.A. (and its associated petitioner) and the State Pharmaceutical Corporation of Sri Lanka (and others), the court addressed whether the award process for a government tender to supply the Rubella Viral Vaccine conformed with prescribed Government tender guidelines and the constitutional guarantee of equal protection as set out in Article 12(1). It was held that the mandatory condition requiring product registration at the time of tender closure was essential for determining the responsiveness of tenders; only the tender submitted by SmithKline Beecham Biologicals S.A. met all mandatory requirements. Decisions made by the Cabinet Appointed Tender Board and the Technical Evaluation Committee based on these criteria were upheld, while subseq
