In the case between Gangasiri (Accused-Petitioner-Appellant) and four others versus the Officer-in-Charge, Badulla Police Station, and another (Respondents), the court addressed the issue of whether the custodial sentences, and subsequent revisions, imposed under section 303 of the Code of Criminal Procedure were correctly applied with regard to the suspension of sentences for first-time offenders convicted of forgery offences causing financial loss and potential environmental harm. It was held that the Magistrate’s sentencing, as revised by the High Court, remained within the statutory discretionary bounds and was justified on legal and factual grounds. The principle reaffirmed is that custodial sentences may be imposed on first-time offenders where warranted by the gravity of the offence
