Akuran Thilakage Alice Mallika (Deceased) vs. Meragal Pedidurayalage Tikira Alias Ananda Piyaratne (Deceased) and others – SC APPEAL NO. 31/2010-2011

In the case between Meragal Kulathilakage Wimal Samaraweera (Substituted Plaintiff) and Meragal Pedidurayalage Tikira alias Ananda Piyaratne (1st Defendant) along with others, the court addressed the issue of entitlement to shares in the property “Atha Wetuna Pitiye Watta” and the proper application of inheritance principles under Kandyan Law. It was held that the evidence established the Substituted Plaintiff’s claim to an undivided half share, clarified the distinction between “paraveni” and “acquired” property under Kandyan Law, and found that the High Court had misapplied relevant legal principles in overturning the District Court’s decision.
