Brief

In the case between Dr. Ajith C.S. Perera (“IDIRIYA”) and government officials including the Ministers of Social Services and Social Welfare, Sri Lanka Tourism Development Authority, Urban Development Authority, among others, the court addressed the issue of enforcement of accessibility rights for persons with disabilities under the Protection of the Rights of Persons with Disabilities Act No. 28 of 1996 and the Disabled Persons (Accessibility) Regulations No. 1 of 2006 (as amended). It was determined that continuing non-compliance with accessibility regulations constituted a violation of constitutional rights to equality and freedom of movement. The principle reaffirmed was that the State holds a legal duty to ensure accessible public infrastructure for persons with disabilities. T
