Kalu Arachchige Amila Duminda v. Secretary, Ministry of Public Administration and Home Affairs – SC FR APPLICATION NO. 389/2012-2018

In the case between several Data Entry Operators/Coding Clerks (Petitioners) and the Secretary, Ministry of Public Administration and Home Affairs along with other administrative officials (Respondents), the court addressed the issue of whether Petitioners were entitled to be absorbed as Grade II Statistical Officers, alleging a violation of their fundamental rights under Article 12(1) of the Constitution due to the Respondents’ refusal to finalize a Service Minute that would regularize their appointments. It was held that, as of 01.07.2009, the Petitioners belonged to the Sri Lanka Information and Communication Technology Service, not the permanent cadre of the Department of Census and Statistics.
