K. M. R. Perera vs Public Service Commission and Others – SC FR APPLICATION NO: 55/2017-2022
In the case between an officer of the Sri Lanka Foreign Service (the petitioner) and the Public Service Commission, Ministry of Foreign Affairs, and other public respondents, the court addressed whether the administrative decision limiting the petitioner’s attempts at the First Efficiency Bar Examination in accordance with Service Minutes ‘P3’ and ‘P4’ was fair, reasonable, and constitutionally valid under Articles 12(1) and 14(1)(g). It was held that the Public Service Commission’s limitation of examination attempts and corresponding impact on salary increments did not violate the petitioner’s fundamental rights. The findings established that the decision followed the applicable statutory provisions, including the Establishments Code, and did not amount to arbitrariness or unjust denial.
