Jayasinghe Pelige Nimal Jayasinghe vs Justice G.W. Edirisuriya – CA WRIT APPLICATION NO.15/2011-2013

The case between Jayasinghe Pelige Nimal Jayasinghe (Plaintiff) and Justice G.W. Edirisuriya (Chairman, University Services Appeal Board), E.M.G. Edirisinghe (Vice-Chairman, University Services Appeal Board), Anton Alfred (Member, University Services Appeal Board), University of Ruhuna, and the University Grants Commission (Respondents/Defendants), addressed the issue of the lawfulness of the Petitioner’s dismissal from his post as University Medical Officer and whether the University Services Appeal Board properly dismissed his appeal for failure to name the correct parties. It was held that the procedural irregularity of not naming the correct appointing and dismissing authority (the Council) as a party in the appeal rendered the appeal fatally defective. The principle reaffirmed is that
