Mohomed Praweis Mohomed Roofed vs M.Riswi – CA 53/98-2013
In the case between Mohomed Praweis Mohomed Roofed (Plaintiff-Appellant) and M. Riswi (Defendant-Respondent), the court examined whether the premises in dispute fell within the application of the Rent Act No. 7 of 1972 and whether the Plaintiff-Appellant was therefore entitled to possession, in light of the District Judge’s prior determination. It was established that, despite procedural lapses by the Appellant in prosecuting the appeal, the merits were considered due to proper lodging and payment of fees. The District Judge’s finding that the premises were subject to the Rent Act was upheld. The case reinforced the principle that appeals, once admitted and not withdrawn, may be reviewed on their merits and that findings supported by evidence from authorized officials and documentary proof
