D. Adiris vs. Secretory, Ministry of Health – CA PHC NO.281/06-2013
In the case between D. Adiris, D. Jayarathna, and D. Chandana Weerarathna (Appellants) and the Secretary, Provincial Director of Health Services, and Deputy Provincial Director of Health Services (Respondents), the court addressed whether the appeal could proceed in light of the appellants’ failure to deposit brief fees as previously ordered by the court. It was determined that, due to non-compliance with the requirement to deposit brief fees, the appeal should be rejected. This outcome reaffirmed the procedural principle that compliance with court orders regarding fees is mandatory for the continuation of appellate proceedings. Reliance was placed on established practice and procedural requirements to maintain the integrity of court processes and enforce judicial directions.
