Pahalage Rajesh Swama Kulasooriya vs Asanka Gunatileka – CA WRIT APPLICATION NO.51/2012-2013
The case between Pahalage Rajesh Swama Kulasooriya (petitioner) and Asanka Gunatileka, Sarath Premaratne, Mahaweli Authority of Sri Lanka, and P.M.U. B. Kapurubanda (respondents) addressed the withdrawal of claims concerning administrative matters under the Sri Lanka Mahaweli Authority. It was determined that, upon an undertaking given by State Counsel for the 1st to 3rd respondents to hold a fresh inquiry into the relevant issues, the petitioner’s application could be withdrawn. As a result, the application was dismissed pro forma without costs. This resolution reinforced the principle that judicial applications may be withdrawn when an alternate remedy, such as a fresh inquiry, is undertaken by the respondent authority in the course of proceedings, permitting dismissal without costs.
