Wanasinghe Mudiyanselage Kapuru Banda v. E.M.D.D. Ekanayake et al. – CA WRIT APPLICATION NO: 230/2012-2015

In the case between Wanasinghe Mudiyanselage Kapuru Banda (petitioner) and, among others, E.M.D.D. Ekanayake and Wanasinghe Mudiyanselae Nimal Herath (respondents), the court addressed the issue of whether there existed a valid nomination of the 5th respondent as successor to Mudalihamy, the original grantee, under the relevant land permit. It was determined that the permit did not contain such a nomination. The court, noting the agreement of both parties, directed that a fresh inquiry be conducted by the Divisional Secretary, Galenbedunuwawa, to determine the rightful successor to the land. This decision reaffirmed the principle that succession under government land permits requires compliance with prescribed nomination procedures, and in their absence, a fact-finding inquiry is warranted
