S.H. Sadikeen and S.A.C. Wahida Rahuman vs. Jagath P. Jayaweera et al. – CA WRIT APPLICATION NO.219/2015-2015
In the case between S.H. Sadikeen and S.A.C. Wahida Rahuman (Wayamba Traders) and officers of Sri Lanka Customs, the court addressed the lawfulness of customs authorities’ detention of containers of Areca (Betel) nuts imported under the TIEP Scheme, specifically regarding the validity and extension of import permits under the Plant Protection Act. It was held that interim release of the detained goods for re-export was warranted, so long as the import orders or shipments occurred during the validity period of the relevant permits and any subsequent extensions covered the arrival date. Permits must be verified, and release was subject to payment of dues and compliance with regulatory restrictions. The court reaffirmed principles governing interim relief and the treatment of perishable goods
