Galagodaaththe Gnanasara Vs. The Attorney General – CA CC 04/2016-2017
In the matter of an Application in terms of Article 105(3) of the Constitution of the Democratic Socialist Republic of Sri Lanka, between the Attorney General and Galagodaaththe Gnanasara (Accused Respondent), the court addressed whether the process for dealing with the contempt application was in substantive compliance with the Civil Procedure Code, specifically Sections 792, 793, and 796. The findings established that despite preliminary objections from the Accused Respondent regarding lack of specificity in the charges and alleged procedural impropriety, the Court of Appeal afforded more than necessary detail and opportunity as prescribed by law, and had duly followed proper procedure.
