Palihewage Kithsiri Jayathilake vs Road Development Authority – CA NO. 463/2013-2018

In the cases of Palihewage Kithsiri Jayathilake and others (petitioners) v. Road Development Authority, Urban Development Authority, North Western Provincial Council, the Attorney General, and others (respondents), the court examined whether the state could be compelled by mandamus to acquire remaining portions of the petitioners’ land after initial portions were given, with consent, for road widening, and whether certiorari could issue to restrain any further widening. All related writ applications were jointly determined. The petitioners had already allowed portions of their land for a road expansion to 33 feet and subsequently sought judicial orders regarding the acquisition of the remaining land portions and to prevent purported further widening.
