The Officer in Charge, Crimes Division vs Mohammed Raasik Mohammed Naazik – CA BAL/31/2021-2022
In the case between Vellathambi Nabila and the Officer in Charge, Crimes Division, Western Province, South District, Pagoda Road, Nugegoda, the court addressed the issue of granting bail under Section 10(1)(a) of the Assistance to and Protection of Victims of Crimes and Witnesses Act No. 4 of 2015. It was held that bail could be granted to the suspect, Mohammed Raasik Mohammed Naazik, due to the lack of independent corroboration of the threat allegation and the prolonged remand without an indictment. The principle reaffirmed was that “exceptional circumstances” justifying bail must be evaluated case by case, especially where there is significant delay and insufficient supporting evidence for further detention. Reliance was placed on statutory interpretation and evolving judicial standards
