Gammpodi Marakkalage Prasad Asela Karunarathne and others Vs The Hon. Attorney General – CA HCC-0065/2013-2022
In the case between The Honourable Attorney General (representing the Democratic Socialist Republic of Sri Lanka) and Gampodi Marakkalage Prasad Asela Karunarathne and Mallawa Archchige Ruwan Kumara Samarasekera, the court addressed the reliability and sufficiency of identification evidence against the accused-appellants following convictions for murder. The main issues examined were the adequacy of eyewitness identification, the evaluation of alleged inconsistencies between medical and eyewitness testimony, and the admissibility of a government analyst’s report without oral testimony. It was held that the child eyewitness’s identification was credible, the documentary and testimonial evidence was consistent, and the analyst’s report was properly admitted under the Criminal Procedure Code.
