In the case between the Hon. Attorney General, representing the Democratic Socialist Republic of Sri Lanka, and the accused-appellants Kirige Wijeratnege Chamil Wijeratne, Herath Hamige Sandun Kumara, and Appurralage Ajith Susantha, the court addressed the issue of whether the sentence of 15 years rigorous imprisonment for robbery (using deadly weapons) was excessive in light of mitigating circumstances and extended pre-trial custody. It was held that, given the over 13 years already served in custody and the contextual factors of the 2007 LTTE disturbances, a reduction of sentence was warranted.
