Sinniah Amirthalingam Delgin (B Division) v. J.M.C. Priyadharshani – CA PHC 208/2015-2021

In the case between J.M.C. Priyadharshani, Competent Authority Director, Plantation Management Supervision Unit, Ministry of Plantation Management (Complainant/Plaintiff), and Sinniah Amirthalingam Delgin, Hedarly Estate, Rakwana (Respondent/Defendant), the court addressed whether the Provincial High Court possessed jurisdiction to exercise revisionary powers in disputes arising under the State Lands (Recovery of Possession) Act No. 07 of 1979. The court determined that the High Court had erred in its interpretation of Article 154P (3)(b) and Article 154P (4) of the Constitution of Sri Lanka when it dismissed the revision application on the ground of lack of jurisdiction. The findings established that the High Court is not excluded from exercising revisionary jurisdiction over such matters
