Lewis Amar Raj Alias Dubai Rajah vs. Hon. Attorney General – CA/HCC/193/2019-2024
In the case between the Hon. Attorney General, Attorney General’s Department, Colombo 12 (Complainant-Respondent) and Lewis Amar Raj alias Dubai Rajah (Accused-Appellant), the court examined the sufficiency and credibility of evidence relating to the appellant’s alleged possession of 102.8 grammes of heroin under the Poisons, Opium and Dangerous Drugs Ordinance. The court determined that minor discrepancies in the testimonies of prosecution witnesses did not diminish the reliability or consistency of the prosecution’s case. It was held that the prosecution discharged its burden of proof beyond reasonable doubt, justifying the conviction and sentence. The appeal was dismissed, reaffirming the principle that minor contradictions do not necessarily discredit the overall prosecution narrative
