Spectrum Pharmatech Lanka (Private) Limited vs. State Minister of Production, Supply and Regulation of Pharmaceuticals – CA CASE INJ/03/2024-2024
In the case between Spectrum Pharmatech Lanka (Private) Ltd and, among others, the State Minister of Production, Supply and Regulation of Pharmaceuticals and the Minister of Health, the court considered the parties’ contractual dispute arising from a Development and Management Agreement for Sri Lanka’s inaugural Pharmaceutical Manufacturing Zone. The main issues involved project delays, alleged failure by investors to meet financial obligations, and concerns over unilateral modifications of investor agreements by state authorities. Judicial intervention was sought through an interim injunction to maintain the contractual status quo pending arbitration. It was determined that an injunction should be granted to preserve the status quo for three months or until the commencement of arbitration
