Mapa Hamilage Sunil Premasiri Mapa vs. Hon. Attorney General – CA HCC 190/2024-2025

In Mapa Hamilage Sunil Premasiri Mapa vs. Hon. Attorney General, decided by the Court of Appeal of the Democratic Socialist Republic of Sri Lanka on 28.03.2025, the case addressed an appeal against conviction and sentencing for grave sexual abuse of a minor under 16 years arising from incidents in June 2008. It was determined that the cumulative evidence, including consistent witness testimonies and expert reports under Section 331(3) of the Code of Criminal Procedure and Article 139 of the Constitution, sufficiently established the appellant’s culpability. It was further determined that discrepancies in the victim’s recollections, attributable to trauma and psychological stress, did not undermine the reliability of the evidence, thereby reaffirming the conviction and sentencing order.
