S.P. Ruwan Kumara vs. Hon. Attorney General – CA 52/2013-2013
In the case between S.P. Ruwan Kumara (Appellant/Accused–Appellant) and the Hon. Attorney General, Attorney General’s Department, Colombo 12 (Respondent), the court addressed the issue of the continuation of an appeal following an application for withdrawal by the accused-appellant. It was determined that, following an application by the counsel for the accused-appellant, the appeal was allowed to be withdrawn and was accordingly dismissed. The decision reinforced the principle that the right of appeal may be relinquished at the instance of the appellant by formal application, leading to the summary termination of proceedings. This outcome emphasized the finality attached to approved withdrawals in the appellate process and the court’s power to dismiss appeals as sought by parties.
