Upasena Weerasinghe v. The Hon. Attorney General – CA WRIT/273/2013-2013

In the case between Upasena Weerasinghe (Accused-Appellant) and the Hon. Attorney General (Respondent), the court addressed the correctness of the conviction and sentences imposed under Section 140 of the Penal Code (unlawful assembly) and Section 296 read with Section 32 of the Penal Code (culpable homicide not amounting to murder). It was held that the conviction was properly entered, but the start date for the eight-year sentence on the culpable homicide count should commence from the date of conviction, and the default imprisonment for nonpayment of compensation should be enhanced from two to four years, to run consecutively, with all other sentences running concurrently. The principle reaffirmed is that sentencing orders must accurately reflect both the facts found and statutory guide
