Yen Unapana Chandawimala Thero v. Chandraprema Gamage et al. – CA APPLICATION NO. 207/2016-2016

In the case between Yen Unapana Chandawimala Thero, Viharadhipathi of Divrumpola Purana Rajamaha Viharaya (Petitioner), and Chandraprema Gamage, Commissioner General of Buddhist Affairs, Wasantha Ekanayake, Secretary to the Ministry of Buddha Sasana, Hon. Wijedasa Rajapaksha, Minister of Buddha Sasana, and the Hon. Attorney General (Respondents), the core issue addressed was whether writs of certiorari and mandamus should issue to quash the removal of the Petitioner from the position of Viharadhipathi and compel a ministerial inquiry under Section 15 of the Buddhist Temporalities Ordinance. It was held that removal was effected solely based on the religious authority and decision of the Mahanayake Thero of Malwatta Chapter, with no independent decision-making or inquiry by state officials.
