Rathanayake Mudiyanselage Chandrasiri Tennakoonwela v. Sri Lanka Medical Council – CA 277/2017-2017
In the case between Rathanayake Mudiyanselage Chandrasiri Tennakoonwela (medical practitioner) and the Sri Lanka Medical Council and others, the court addressed whether the decision of the Professional Conduct Committee of the Sri Lanka Medical Council to suspend the petitioner’s registration for five years, based on proven charges of sexual intercourse with a female patient, should be quashed by writ of certiorari. It was held that the disciplinary inquiry was properly conducted, the charges were sufficiently established through the petitioner’s own admissions under oath, and the lack of defense evidence further substantiated the findings. The principles of administrative law regarding disciplinary proceedings and the sufficiency of proof in professional misconduct cases were reaffirmed.
