Mohan Nihal Anura Samarasekare v. Mr. R.P.A. Wimalaweera et al. – CA WRIT APPLICATION NO. 394/2018-2021
In the case between Mohan Nihal Anura Samarasekare (Petitioner) and Mr. R.P.A. Wimalaweera, Commissioner General of Labour, along with other Labour Department officials (Respondents), the court addressed the issue of whether judicial writs of Certiorari and Mandamus should be issued under Article 140 of the Constitution of Sri Lanka in light of previous actions and decisions by the Labour Department officials. It was held that the matter had already been concluded based on a formal settlement recorded in court, pursuant to the withdrawal of the application by the Petitioner. The court reaffirmed the principle that once a settlement is recorded and proceedings are concluded, the matter cannot be re-agitated, and parties retain the right to implement the settlement terms.
