Free Trade Zone and General Services Employees Union (FTZGSEU) vs B.K.P. Chandrakeerthi et al. – CA WRIT/303/2022-2023

The case between the Free Trade Zone and General Services Employees Union (and other unions and employees) and B.K.P. Chandrakeerthi, R.P. Iresha Udayangani, and JK Apparel Manufacturing Limited addressed whether the decision of the Commissioner General of Labour, made under the Termination of Employment of Workmen (Special Provisions) Act (TEWA), to permit the termination of services of certain employees was exercised lawfully and conformed to natural justice. The court held that the Commissioner acted within the scope of absolute discretion granted by statute and that the requirements of procedural fairness were met under the circumstances. This holding reaffirmed the principle that the nature and scope of a hearing or inquiry, as required under TEWA, do not always mandate a full inquiry
