Mannage Oshan Dharshana Wijesiri vs. The Officer in Charge, Criminal Investigations Department, and The Attorney General – CA CPA/0057/2023-2023

In the case between Mannage Oshan Dharshana Wijesiri (Petitioner, on behalf of his brother Mannage Dilshan Harshana Wijesiri) and the Officer in Charge of the Criminal Investigations Department, Colombo 01, with the Attorney General of Sri Lanka (Respondents), the court addressed the issue of whether the High Court correctly applied the bail provisions under the Prohibition of Ragging and Other Forms of Violence in Educational Institutions Act No. 20 of 1998 and the Bail Act, in refusing bail to the suspect. It was held that the High Court’s order refusing bail lacked adequate legal reasoning as required by statute, rendering the order unlawful. The principle reaffirmed was that bail decisions under the relevant statutory provisions must contain clear and sufficient reasoning, anchored in
