Commander(S) R.G.A.A. Weerasinghe vs Commodore K.R. Senadheera – CA/WRT/538/2011-2025

In the Court of Appeal of the Democratic Socialist Republic of Sri Lanka, an application for a Writ of Certiorari under Article 140 of the Constitution was reviewed. Commander R.G.A.A. Weerasinghe, as petitioner, contested a Court Martial conviction dated 05.01.2011, which stemmed from a Board of Inquiry recommendation regarding charges of selling kerosene to a civil party. The petitioner alleged irregularities in the Board of Inquiry, violations of Regulation 13 of the Navy (Board of Inquiry) Regulation of 1975, breaches of natural justice, ultra vires actions, and suppression of material facts. The respondents argued that proper evidence was presented, procedures were followed, and the President’s ratification removed the matter from writ jurisdiction.
