Christoffelsz vs Sleyma Lebbe – clr volume 1 page 005
In the case between Christoffelsz (Plaintiff) and Sleyma Lebbe (Defendant), the court addressed whether a Municipal Magistrate, who is also the Municipal Chairman and responsible for directing the prosecution, may validly preside over the trial in which there is a personal interest. It was held that a person must not adjudicate proceedings where personal or institutional interest exists, particularly when prosecutorial conduct may compromise judicial impartiality. The principle reaffirmed is that statutory authority does not override the rule that prohibits a judge from judging where personal interest or conflict is present. Reference was made to the Municipal Councils Ordinance section 55, the Criminal Procedure Code, and established common law principles regarding judicial impartiality.
