Kotagala Plantations Ltd. and Lankem Tea & Rubber Plantations (Pvt) Ltd. vs. Ceylon Planters Society – SC APPEAL 144/2009-2010

In the case between L.P.D. Seneviratne (workman/applicant) and Kotagala Plantations Ltd., Lankem Tea & Rubber Plantations (Pvt) Ltd, and others (respondents/employers), the Supreme Court addressed whether the termination of employment of the workman for alleged misconduct was legally justified and examined the scope of judicial review over factual determinations by the Labour Tribunal. The holding determined that the Labour Tribunal was correct in upholding the dismissal based on evidence of misconduct, and that the High Court erred in reversing this finding and awarding compensation on an improper assessment of evidence and past conduct. It was reaffirmed that appellate courts should refrain from substituting factual judgments of tribunals unless findings are perverse or erroneous in law.
