The People vs Mazur Ivegen and Iana Bereznah – SC APPEAL- TAB/01/2015-2015
In the case between Mazur Ivegen and Iana Bereznah (the 1st and 2nd Accused) and the Hon. Attorney General, the Supreme Court addressed the admissibility and sufficiency of evidence regarding charges of conspiracy to commit murder, murder, attempted murder, and abetment concerning victims Victoria Kim, Jason Kim, and Daisy Manohar. It was held that although the evidence against the 1st Accused for specific murders was overwhelming, the collective evidence, particularly regarding conspiracy and the pre-stabbing agreement, was insufficient to support a conviction on all charged conspiracies. The Court relied on testimonial, forensic, and mobile phone evidence, and scrutinized procedural fairness in the trial. The death sentence on count 1 was set aside, sentences on other counts were reduced
