In the case between select petitioners (public servants and candidates who sat for the Limited Competitive Examination–2007 for recruitment to Class III of the Sri Lanka Administrative Service) and a series of respondents including the Commissioner of Examinations, the Secretary of the Ministry of Public Administration and Local Government, and several appointed candidates, the legal issue concerned allegations of examination malpractice—specifically, the leakage of the ‘Case Study’ paper—and whether this, along with procedural shortcomings in the applicants’ filings, constituted a violation of fundamental rights under Article 12(1) of the Constitution. It was held that the petitioners failed to comply with the one-month rule prescribed by Article 126(2) and further failed to appropriately
