S.D. Nirmala Janaki Malkanthi Weerasinghe vs. The Director, Women and Children Bureau of the Police and others – SC FR 266/2014-2024

In the case between S.D. Nirmala Janaki Malkanthi Weerasinghe (Petitioner) and several police officials including the Director and Officer-in-Charge of the Women and Children Bureau, Inspector of Police Samson Fernando, and an officer from the National Child Protection Authority (Respondents), the central legal issue concerned allegations of sexual abuse by the 7th Respondent and claims that the investigation lacked impartiality and independence, thus purportedly infringing the Petitioner’s fundamental rights under Article 12(1) of the Constitution. The findings established that despite multiple investigations, including judicial and medical examinations, and the involvement of the Attorney General, there was no evidence substantiating collusion or bias by the 1st, 2nd, and 4th Respondents
