Director General, Commission to Investigate Allegations of Bribery or Corruption vs Sandresh Ravindra Karunanayake – SC APPEAL NO 61/2024-2025
In the case between the Director General, Commission to Investigate Allegations of Bribery or Corruption (CIABOC) and Sandresh Ravindra Karunanayake, and Arjun Joseph Aloysius the court addressed the issue of whether an accused party under the Bribery Act/Anti-Corruption Act, particularly a Member of Parliament and Minister, is statutorily entitled to appeal an interim order of the High Court prior to conviction, and whether proper parties had been named in the proceedings. It was held that the statutory framework does not provide an accused with a right of appeal against such interim orders, and that the applications for leave to appeal were misconceived on this basis. The court reaffirmed the principle that rights of appeal in criminal matters arise only upon conviction unless otherwise
