Polwatte Telebulgalage Wimalarathne vs Nainakadayalage Amaradasa and others – S.C. Appeal 73/2012-2025

This case involves an appeal by the Plaintiff against the dismissal of an action for declaration of title and ejectment. The Plaintiff sought title to a 54-perch land and ejectment of the Defendants, who claimed lawful tenancy and had constructed a studio. Despite dismissing the Plaintiff’s action, the District Court made findings in favor of the Plaintiff’s title, subject to co-owner’s rights. The High Court affirmed this dismissal.
