Rajapaksha Mudiyanselage Amarananda Rajapaksha vs P.S. Pushpakumara and others – SC (FR) No. 66/2024-2025

In the matter of Rajapaksha Mudiyanselage Amarananda Rajapaksha (Petitioner) acting for his son Rajapaksha Mudiyanselage Janula Uthsara Rajapaksha vs. P.S. Pushpakumara (1st Respondent) and others.
The court addressed the issue of alleged infringement of fundamental rights under Article 12(1) of the Constitution, stemming from the 1st respondent’s actions in striking off marks for school admission based on disputed residency.
It was determined that the 1st respondent acted arbitrarily and unreasonably in disregarding submitted documentation, including lease agreements and a deed of gift, which supported the petitioner’s continuous residency.
