Wahab v. Jayah – sllr 1988 volume 1 page 078
In WAHAB v. JAYAH, the court examined whether an agreement to sell property constituted a legal disposal under Section 10 of the Ceiling on Housing Property Law, and if the property vested automatically with the Commissioner of National Housing when no valid disposal occurred within the statutory period. The validity and impact of the estoppel doctrine were also considered, especially in the context of alleged eviction by title paramount. The court held that an agreement to sell was insufficient for statutory disposal; thus, the property vested automatically in the Commissioner by operation of law. Further, no evidence established that eviction by title paramount had occurred to relieve the tenant of liability. Orders were made for ejectment, with the plaintiff entitled to arrears and cost
