In the case of Ghaffar v. Vivian Perera, the court examined whether, under the Rent Restriction (Amendment) Act, No. 12 of 1966, a landlord was obligated to provide one month’s or three months’ notice to terminate the tenancy of premises where the standard rent did not exceed Rs. 100 per mensem. The issue centered on the interpretation of statutory and common law notice periods in the absence of an express statutory provision. It was determined that, for premises with a standard rent not exceeding Rs. 100, the legislative provisions did not mandate a three-month notice period and thus the common law standard of one month’s notice sufficed.
