The case between Seemitha Athugalpura Paudgalika Bus Samagama (and its Chairman) and the North Western Provincial Council Road Passenger Transport Authority examined whether a writ of quo warranto could be issued against the occupation of the post of Assistant Director (Operations), and whether the petitioner had standing to challenge the appointment based on the respondent’s qualifications. It was held that, as the alleged office did not in fact exist as an independent, substantive office of a public nature, and the 2nd Respondent only held the role under contractual or delegated authority, there was no ground to grant the writ.
